Toxic Substance Lawsuit Information
If you are considering legal action for your case, here are some things you need to know:

  • When someone is exposed to and harmed by a toxin due to the fault of someone else, this is considered a "toxic tort." "Tort" is a legal term for an act that harms someone but is not criminal.
  • To win a toxic substance lawsuit, you must prove that it was "more likely than not" that a toxin was unsafely produced, packaged, released or that it was supplied with inadequate instructions or warnings.
  • You also have to prove that you were exposed to the toxic substance. Proof of this may involve examinations by doctors and toxicologists (specialists in toxins). Complications may come up here if there aren’t any definitive tests to determine the level of the toxin in your body.
  • You have to prove that the toxic substance caused your illness. This may be difficult because we just don’t know why some people get diseases like cancer. There may be more than one toxic substance involved. And sometimes the effects of toxic exposure don’t show up for years.
  • You also have to prove that the defendant had a responsibility to protect you from harm. The apartment owner was supposed hire a professional company to remove the asbestos. Your employer was supposed to clear the building before fumigating for rodents. The herbicide company was supposed to put a warning label on the weed killer. In legal terms, this involves a "legal duty" or the idea that a party is responsible for damages only when it is foreseeable that harm will result. "Strict products liability" holds manufacturers responsible for defective products. "Breech of warranty" means the product did not work like the company said it would.
  • Finally, you have to prove that you suffered damages. You may be able to recover costs for past and future medical expenses, past and future pain and suffering, lost wages, loss of future earning capacity, and punitive damages, which punish the defendant for wrongful conduct.

Filing a Toxic Substance Class Action Suit
One more idea. If you know a number of people who have been injured by the toxic substance that made you sick, you may want to consider filing a "class action suit." Class actions can involve only a few people, but usually thousands of people will be "members" of a class action suit. This may help your case. A large quantity of people with the same illness helps prove that it was exposure to one toxin that caused the problem.
